1. Website and App Usage

By using CostaExCursions’s website, you agree to be legally bound by these terms, which shall take effect immediately.

Please do not access and/or use the website if any of the following are true:

  • You do not agree to be legally bound by all of the following Terms & Conditions.
  • You are under 18 years of age.
  • You do not have the legal authority to enter into a binding agreement.
  • You are booking on behalf of an individual without full authority to enter him into a binding agreement on his behalf.
  • You have not read all of the terms and conditions contained herein.

CostaExcursions may amend, alter, and change these Terms & Conditions at any time by posting changes on the website. Please review these Terms & Conditions regularly to ensure you are aware of any changes made by CostaExcursions. Your continued use of the website after changes are posted means that you agree to be legally bound by these terms as updated and/or amended. No modification to these Terms & Conditions will be binding on CostaExcursions unless authorized in writing signed by an authorized officer of CostaExcursions or posted on the website.

You are prohibited from copying, reproducing, republishing, downloading, posting, broadcasting, transmitting, making available to the public, or otherwise using the website´s content (including text, images, URLs, pricing information, etc.) in any way except for your own personal, non-commercial use. Any other use of the website’s content requires the prior written permission of CostaExcursions.

You agree to use the website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of the website

Your use of the websites is intended for personal, noncommercial use and/or to make legitimate requests to book the products or services offered. You agree not to use this website to make any speculative, false or fraudulent requests. You agree that all information you provide will be true, accurate, current and complete.

You agree not to use robots, spiders or other automated means to access the website unless specifically permitted in writing by CostaExcursions.

You agree not to bypass or circumvent measures employed to limit or prevent access to the website, to “frame” or “mirror” any part of the website into any other website, or to “deep-link” directly to any portion of the website, including the purchase path for any shore excursions or day trips.

Although CostaExcursions will seek to keep the website accessible and secure at all times, CostaExcursions makes no warranty as to the uninterrupted accessibility or security of the website.

2. User Accounts

You have the option to create an account and provide information about yourself in order to use some of the features on the website. You are responsible for maintaining the confidentiality of your account password. You are also responsible for all activities that occur in connection with your account. You agree to notify CostaExcursions immediately of any unauthorized use of your account. If you store any information related to your CostaExcursions account on a mobile device or computer, you agree to delete any such information before transferring the device to a new owner. You agree not to store any such information on a public computer or in any other place where it can be accessed by others.

Your account is for personal, non-commercial use only. You may not impersonate someone else (e.g., adopt the identity of a celebrity), create an account for any other person, provide an email address other than your own, or create multiple accounts.

CostaExcursions reserves the right to close your account at any time for any or no reason, at its sole discretion.

3. Booking Process

All booking requests must be submitted with valid payment information. When paying for a shore excursion with a credit card, you confirm that you are the authorized cardholder or that you have been authorized by the cardholder to use the credit card for this purpose. In the event that the credit card is dishonored, rejected or later contested for any reason, you agree to pay the amount indicated on the booking confirmation page to CostaExcursions. CostaExcursions reserves the right to cancel your booking if payment is not received in a timely fashion.

All prices and availability will be confirmed to you within 48 hours. If the shore excursion is within the next 48 hours, the booking will be processed as quickly as possible but no guarantee can be given that the shore excursion or day trip will be booked.

You will be charged in full for the shore excursion when the tour operator confirms the booking request. A confirmation email and invoice in PDF will be sent to you at the e-mail address you provide within 24 hours following payment for the excursion. The PDF will include a receipt for the purchased excursion, description of the purchased excursion and a Guide/Driver´s slip.

Please print your Guide/Driver´s lip and hand it into your guide/driver at the port of call or at your pick up location in case of day excursions. Your guide/driver will be waiting for you at your ship terminal exit point or pick up location in case of day excursions.

CostaExcursions charges all its excursions Euros. Credit card charges may differ slightly based on the time of credit card company charge.

4. Physical Requirements

The physical requirements of the participants of each shore excursion and the overall conditions of the excursion, including transportation to and from the excursion, are specified individually in the description on the website.

It is your responsibility to affirm that you and all members of your party understand and are able to meet the physical requirements prior to completing the booking request. CostaExcursions takes no responsibility for checking or validating, verify, inspect or otherwise determine the physical health of any guest, nor any guest’s ability to participate in an excursion.

All participation is at the sole decision of the guest and CostaExcursions is not liable for any health concerns or complications that result from an excursion.

5. Right of Refusal

CostaExcursions has the right to refuse service to any guest for any lawful reason.

If CostaExcursions refuses service to a guest, no refund will be offered.

6. Cancellation / Refund Process

You can cancel a booking for a full refund up to 10 days before the excursion is scheduled to take place. This is measured against the start of the day of the excursion in the local time zone where the shore excursion is to take place.

No refunds will be offered for any cancellations that occur within 10 days before the excursion is scheduled to take place.

No refunds will be made to any guest who fails to show up for a shore excursion departure at the designated time and place, or who leaves or otherwise does not use all of the services scheduled to be provided by an excursion.

Most excursions will operate in a variety of weather conditions, if the excursion cannot take place due to weather, or an equipment problem prevents CostaExcursions from providing the excursion, a full refund may be issued at CostaExcursions’s sole discretion.

Members of any excursion who elect to leave the designated excursion transportation must provide their own transportation at their own expense back to the landing place of the ship or excursion origin.

CostaExcursions reserves the right to cancel confirmed shore excursions. While we expect this to happen very rarely, a full refund will be paid if this occurs.

If the ship does not arrive at the port of call for whatever reason, the shore excursion fee will be refunded. It is your responsibility to notify CostaExcursions in writing of the circumstances within 7 days of the scheduled shore excursion departure and request the refund accordingly.

If the ship is delayed in arrival and clearance to the port so that you cannot make the scheduled shore excursion, the excursion may be refunded to you only if you adhere to the following requirements:

  • You must notify CostaExcursions within 7 days of the missed shore excursion.
  • You must provide CostaExcursions any supporting documentation required for their investigation.

Any other requests for refunds, while unlikely, will be decided on a case by case basis and shall be decided using the sole discretion of CostaExcursions.

Occasionally CostaExcursions may make changes to excursion dates, prices, inclusions, coverage, age requirements, etc. As a result, CostaExcursions reserves the right to cancel, change or substitute any service, excursion, ticket or product that you have booked at the website, at any time, for any reason.

In such cases, if you are dissatisfied with the alternatives offered, you may be entitled to a full refund of the original purchase price.

Notwithstanding the above, we make every reasonable effort to work with you, in order to amend or re-issue the booking where feasible.

7. Personal Items

All personal items, including coats, cameras, phones, handbags, and similar personal articles should remain at all times throughout the excursion under the personal control of the guest.

CostaExcursions is not responsible for the loss, theft, or damage of personal items while a guest is on an excursion.

8. Missing the Ship

CostaExcursions is not responsible if you are not returned to the ship in time to board.

If you are not returned to the ship in time to board for any reason, you will need to make arrangements to meet the ship at the next port of call.

If you are not returned to the ship in time to board due to the fault of CostaExcursions or the tour operator’s equipment, receipts related to the travel to the next port of call to join the ship can be submitted for reimbursement up to a maximum value of US $500 per person.

All receipts for transportation, meals, and lodging must be retained and submitted for reimbursement to CostaExcursions within 7 days. CostaExcursions reserves the right to determine fair and reasonable reimbursement for expenses incurred based on receipts submitted.

This reimbursement policy applies only to our excursions and only when, through no fault of action of you or any member of your party, you are not returned to the ship in time to board.

This reimbursement policy does not apply in instances where the delay is caused by your own actions and/or you have deviated from the CostaExcursions activity or excursion. You must supply CostaExcursions with correct arrival and departure ship information and ensure there is enough time (a minimum of 2 hours) between the excursion end time and the ship departure time.

9. Content

CostaExcursions will provide all customers who complete an excursion the opportunity to provide feedback in the form of a rating or a written review, or both. You should not make false or misleading statements in any written review, nor should you accept any discount or other incentives from a tour operator to provide a more favorable review.

By submitting any content to the website, you grant CostaExcursions a nonexclusive, royalty-free, perpetual, transferable, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, translate, distribute, publish, create derivative works from and publicly display such submission in any medium and any location. CostaExcursions (and its sublicensees/transferees) may choose to use the name you provide with your submission, at its discretion. CostaExcursions has the right to publish, not publish, or remove any content you submit without notice to you. CostaExcursions takes no responsibility and assumes no liability for any submissions provided by you.

You are solely responsible for any content you submit. You may not submit any content to the website that is:

  • Threatening, libelous, defamatory, obscene, pornographic, or in violation of any right of publicity/privacy or any other law
  • Commercial material or content (including soliciting funds and advertising any goods or services)
  • In violation of any third party’s copyright, trademark, patent, or other property rights

You shall be solely liable for any damages resulting from any violation of these requirements or any other harm resulting from your submission to the website and shall fully indemnify CostaExcursions (and its sublicensees/transferees) for any resulting claims.

If you do not agree to these conditions, please do not submit any content to the website.

10. Communication Services

CostaExcursions may make email service and other communication options to users of our website.

11. Legal Disclaimers and Dispute Resolution

Except as expressly provided in these Terms & Conditions, CostaExcursions makes no warranties (including implied warranties) or representations (including as to the accuracy or completeness of any information about any shore excursion, or the quality of any products or services) as to any customer and disclaims all liability for any damages, direct or consequential, that may arise from use of the website or any excursion sold through CostaExcursions.

You agree to indemnify and defend CostaExcursions, and each of its officers, directors, employees, and agents from and against any claim, cause of action or demand, including reasonable legal and accounting fees, in any action filed or commenced by any third party against CostaExcursions as a result of:

  • Your breach of these Terms & Conditions
  • Your violation of any law or the rights of any third party
  • Your use of the websites/apps

You agree that any and all disputes, claims, and causes of action arising out of, or connected with, your use of the website or these Terms & Conditions, shall be resolved exclusively, and without resort to any form of class action, by the appropriate courts in Malaga, Spain.
